1. OVERVIEW

The Footy Show is going to send out a team of Nissan Navara Tough Love tradesmen to six (6) properties between April and September 2014. We are seeking local football clubs, schools or homes that need a little “tough love” help from our team of tradesmen. The Footy Show will film the tradesmen at work on the properties and the properties will be featured in a segment on The Footy Show (Segment).

2. WHO CAN ENTER
2.1. The Nissan Navara Tough Love competition (the Competition) is open to residents of Australia who are 18 years and older (if nominating a local club house or school, the entrant must be authorised by the club or school to enter this Competition) (Entrants).

2.2. Entrants may apply on behalf of their local club house, school or in their own capacity and must agree to the terms and conditions of the Competition process as outlined in these terms and conditions (Competition Process).

2.3. If the Entrant is applying on behalf of their club house or school it is the responsibility of the Entrant to ensure that they have obtained the consent of their club house or school to enter. Promoter accepts no liability for Entrants who are disqualified because they have not obtained the proper consent.

2.4. The process of working on the local football clubs, schools or houses will be recorded by the Promoter and the recordings may appear as segments on Channel 9’s The Footy Show (and other media associated with Promoter). The filming of each segment may occur on multiple filming dates across the 2014 Footy Show (AFL) Series.

2.5. This Competition is not open to any employees of the Promoter, the Sponsor or any of their agencies involved with this promotion or members of the immediate family of such employees.

3. HOW TO ENTER

3.1. The Competition commences on 20 March 2014 at 17:00 AEDST and ends on 1 September 2014 at 9:00 AEST (Competition Period).

3.2. To be eligible to enter the judging for the Major Prize, entrants must submit their entries between 17:00 AEDST on Thursday 20 March 2014 and 12:00 AEDST on Friday 28th March 2014 (Major Prize Entry Period). To be eligible to enter judging for the Minor Prizes, entrants must submit their entries during the Competition Period.

To enter, Entrants must:

a) go onto www.jump-in.com.au and follow the prompts to the registration page;
b) input the requested details including full name, full street address, email address, telephone number and answer in 100 words or less: why you need help from the Nissan Navara Tough Love tradesmen?
c) select the type of property where the works will take place and select who owns the property;
d) insert the address of the property where the works will take place and a description of what works are required; and
e) read and accept the terms and conditions, Nine’s privacy policy, Nine’s Collection Statement and submit a completed Competition form,

AND the entry must not be, without limitation:

a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libellous;
j) threatening;
k) pornographic;
l) harassing;
m) hateful;
n) racially or ethnically offensive;
o) capable of encouraging of conduct that would be considered a criminal offence;
p) capable of violating any law;
q) capable of giving rise to civil liability.

3.3. Entries must be received within the Competition Period.

3.4. All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.

3.5. Multiple entries permitted, subject to the following: each entry must be submitted separately and in accordance with entry requirements and must be substantially unique.

3.6. Entry details remain the property of the Promoter and will not be returned to the Entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.

3.7. The Promoter reserves the right to verify the validity of entries at anytime during or after the Competition Period, and reserves the right to disqualify any entrant who tampers with the entry process (including but not limited to tampering by way of the utilisation of techniques designed to avoid the payment of postage costs) or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

3.8. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Entrants should not send in original copies of their entries. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing.

4. PRIZE/PRIZES
4.1. There will be one (1) Major Prize winner and the winner will receive:
a) a 2014 Nissan X-Trail Ti (or other X-Trail model available for the winner to choose) valued at up to $48,343 drive away
b) a visit from the Tough Love tradesmen to undertake minor renovation works at the entrant’s nominated property up to the value of $10,000.

4.2. There will be five (5) Minor Prize winners and they will each receive a visit from the Tough Love tradesmen to undertake minor renovation works at the entrant’s nominated property to the value of $10,000.

4.3. The total maximum prize pool value is $108,343. The prize values are correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.

4.4. The Major Prize winner will have the option to choose any X-Trail model within the range of X-Trail models up to Nissan X-Trail Ti model range

4.5. The Nissan X-Trail awarded to the Major Prize winner will come with on road costs including 12 months registration, 12 months compulsory third party insurance, stamp duty, other applicable charges and dealer delivery and administration charges.

4.6. All car optional extras and accessories, extended comprehensive insurance and any other insurance not stated as included in the prize, fuel, personal costs and any other ancillary costs associated with redeeming the prize are excluded and are the responsibility of the winner.

4.7. If the winner has entered the Competition on behalf of their club, school or another individual, the prize vehicle will be awarded to the club, school or individual that is nominated by the Entrant. An authorised representative of the club, school or individual must comply with the requirements for acceptance of the prize vehicle as described in these terms and conditions.

4.8. The Major Prize winner (or the club or school’s authorised representative) must provide all information and sign all documentation necessary to enable the Promoter to register the car prize in the winner’s/club’s/school’s name prior to collection. Receipt of the car prize is subject to the winner/club/school being able to lawfully take possession of the car prize and comply with all registration and compulsory third party insurance requirements of the State/Territory in which the winner/club/school elects to register the car prize. If the winner/club/school is, through any legal incapacity or otherwise, unable to register the car prize in their own name, then such winner/club/schoool may assign the car prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner/club/school and the assignee. The winner/club/school must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded.

4.9. The Major Prize winner (or the club or school’s authorised representative) must have a current valid Australian state or territory driver’s licence. It is a condition of winning the car that the winner (or the club or school’s authorised representative) provides the Promoter with their full name, address, and a copy of their current Australian state or territory driver’s licence prior to the awarding of the Prize.

4.10.The car prize depicted in all promotional material is not necessarily the same colour as the Prize. The external and internal colour of the car is subject to availability.

4.11.The car awarded to the winner may have some existing small mileage on the speedometer. The Promoter takes no responsibility for any mechanical, body or paint repairs to the car from the date and time of delivery.

4.12.In acceptance of the Prize, the winner acknowledges that they may incur ongoing costs associated with the Prize which are the entire responsibility of the winner.

4.13.If the winner is unable to collect the vehicle, the winner may incur cost of transporting the vehicle, if needed, from their nearest dealership to an alternative prize claim point as nominated by the Winner and deemed acceptable by the Promoter. Any costs associated with the transport of the vehicle to an alternative location will be the responsibility of the Winner.

4.14.The nominated club house/school/home of the winners will each receive a visit from the tradesmen to undertake minor renovation works up to the value of $10,000.

4.15.No works of a structural nature will be undertaken or any work which is deemed by the Promoter (in its absolution discretion) to be, without limitation, too costly, dangerous, time-consuming or outside the experience of the tradesmen engaged by Nine.

4.16.The Promoter will consult with the winners and/or the authorised representative of the nominated property to determine the time and date when the renovation works will take place.

4.17.The renovation works will not commence until such time as the property owner or the property owner’s authorised representative has signed a waiver and release as described in clause 6.4 of these term and conditions.

4.18.Promoter will not be responsible for any costs other than the cost involved in undertaking the renovation works.

4.19.The Prize must be taken as offered. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be redeemed as cash. The Prize is not valid in conjunction with any other offer. The Prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

4.20.It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

4.21.In the event that for any reason whatsoever the winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

4.22.In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.

5. JUDGING

5.1. Each valid entry received during the Major Prize Entry Period will be submitted for judging by a panel of judges appointed by the Promoter. Judging for the Major Prize will take place on Thursday 27 March 2014 at 12:00 AEDST. The one (1) Entrant whose entry is deemed the most creative and original out of all valid entries received, and subject to the entrant satisfying the prize selection and acceptance criteria described in these terms and conditions, will be deemed the Major Prize winner.

5.2. Each valid entry received during the Competition Period will be submitted for judging by a panel of judges appointed by the Promoter. Judging for the Minor Prizes will take place at such times during the Competition Period as determined by the Promoter. The five (5) Entrants whose entries are deemed the most creative and original out of all valid entries received, and subject to the Entrants satisfying the prize selection and acceptance criteria described in these terms and conditions, will be deemed the Minor Prize winners.

5.3. The prize winners will be notified by telephone and/or email, using the details provided in their entry.

5.4. It is a condition of selection that the Entrant and/or such other authorised representative of the club or school undergo a selection process and complete Competition forms to determine the Entrant’s and the property’s suitability for the Segment.

5.5. All Entrants selected by the judges will be contacted to arrange a site visit to the nominated property by the Promoter’s representatives and the foreman engaged by Promoter.

5.6. The site visit of the nominated property will determine whether the property is suitable for the renovation works and whether the works required are suitable for the Segment. If the Promoter determines (at its absolution discretion) that the property is not suitable for the nature of the Segment or the works required are not suitable, the Entrant and the Entrant’s nominated property will forfeit their opportunity to participate in the Segment.

5.7. As part of the selection process Entrants may be required to provide documentation requested by Promoter including but not limited to evidence of council approval, appropriate public liability or residential insurance, consents to police and background checks.

5.8. The interview process described above and the additional selection verification will be conducted by Promoter and entrants must satisfy these requirements in the manner required by the Promoter and according to the deadlines required by the Promoter in order to be the selected as winners.

5.9. The Promoter reserves the right to disqualify any Entrant submitting an entry which, in the opinion of Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language.

5.10.Incomplete or indecipherable entries will be deemed invalid.

5.11.Promoter’s decision is final and no correspondence will be entered into.
