TERMS AND CONDITIONS

By entering “The Daily Telegraph’s Nova’s Red Room Global Tour ” promotion, you are agreeing to the following terms and conditions:

1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions for entry.

2. WHO CAN ENTER

2.1 Subject to clause 2.2, entry is open to all residents of NSW.

2.2 Directors, management, employees and their immediate families of Nationwide News and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

2.3 Entrants and their companion (if applicable) must be 21 years of age or over.

2.4 Entrants and their companion (if applicable) must, in order to be declared a Prize winner, be the holder of a current passport with at least 6 months validity from the Travel Date.

2.5 Entrants must be able to travel internationally on Wednesday 3rd September

3. HOW TO ENTER

3.1 The Daily Telegraph’s Nova’s Red Room Global Tour promotion will commence on Monday August 11, 2014 at 00:01 (AEDST) and finish on Thursday 21, 2014 at 23:59 (AEDST) know as the “The Promotional Period”.

3.2 To enter applicants must enter via The Daily Telegraph facebook page or fill out a form on the Sydney confidential website at http://www.dailytelegraph.com.au/entertainment/sydney-confidential https://www.facebook.com/dailytelegraph?ref=br_tf) and tell us in 25 words or less “What is the greatest distance travelled to see a live music performance?”

3.3 Entries received later than the promotional period will be deemed invalid and not entered into the competition.

3.4 Entrants in the competition may enter as many times as many as they like.

3.5 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.

3.6 Incomprehensible and incomplete entries will be deemed invalid.

4. HOW TO WIN

4.1 All valid entries into The Daily Telegraph’s Nova’s Red Room Global Tour promotion during the nomination period (as per clause 3.2) will be judged by a judging panel, as determined by the Promoter. The Judging process will take place on Thursday August 21, 2014 at 10:00 (AEDST) at 2 Holt Street, Surry Hills, NSW where all valid entries will be considered. This is a game of skill and the judge’s decision is final. A reader and a friend will joint Nova’s Red Room Global Tour ad see Samantha Jade perform exclusively in Qantas’ new Los Angeles Business Lounge. All winners will be selected from all entries received. Winner will be contacted by email and their name announced on thetelegraph.com.au on Thursday 21, 2014 at 17:00 (AEDST).

4.2 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.

4.3 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

4.4 Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the judging. Indecipherable or incomplete entries will be deemed invalid.

4.5 The Promoter reserves the right to request that the winners provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

4.6 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry if of a type described in this clause.

5.2 Prizes are not exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in the prize value.

5.3 If a winner, for whatever reason, is not able to take an element of the prize, the prize is forfeited. Cash will not be awarded in lieu of the prize or element thereof.

5.4 If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ control, the Promoters will endeavour to provide a substitute prize of equivalent value & nature.

5.5 To the full extent permitted by the law, the Promoters exclude liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity revenue or profit) arising directly or indirectly out of or in connection with this promotion.

5.6 All prizes will be supplied and fulfilled by Aerogard directly with the prize winners.

6. NO LIABILITY

6.1 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Neither is the Promoter responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries.

6.2 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.

6.3 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:

a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

b) any theft, unauthorised access or third party interference;

c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

d) any variation in prize value to that stated in these conditions of entry;

e) any tax liability incurred by a winner or entrant;

f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or

g) participation in the prize.

6.4 Once prizes have left the promoter’s premises, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.

6.5 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

7. PRIVACY CONSENT

7.1 Nationwide News, as the Promoter of this competition, collects your personal information to assist us in providing the goods or services you have requested, to process your competition entries and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including email or SMS) at any time to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities that assist us in providing our services, running competitions (including administering the competition or distributing prizes) or with other companies who provide prizes for competitions or reader offers. We may also disclose your personal information in accordance with these terms and conditions if you are a prize winner or finalist.

7.2 This company is part of a global media and entertainment company. We would like to share your information with these overseas-related companies so that they can contact you with special offers. 7.3 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winners grant the Promoter a perpetual and non exclusive licence to use such footage and photographs in all media worldwide and the winner (and their companions) will not be entitled to any fee for such use.

7.4 The prize winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) and social media activity (including blogging and tweeting from the event) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

7.5 The winners agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

8. Major Prize Terms and Conditions

8.1.1 As a condition of accepting and participating in the Major Prize, the Major Prize winner and their companion (if any) acknowledge and agree:

that they may be required to attend, undergo and pass any appropriate training, briefings, safety demonstrations, requisite medical tests and other requirements of the Promoter and any partnering clients as determined by them in their absolute discretion;

that they may have to participate in Nova-themed events and/or activities whilst taking the Major Prize and/or as directed by the Promoter in the absolute sole discretion of the Promoter and partnering clients;

that the Promoter or its agents may film, photograph and record the Major Prize winner and their companion (including, but not limited to, during the course of their participation in the Major Prize) and that such footage will be the property of the Promoter and may be edited;

that the Promoter, its agents and its partnering clients may use the winning entry and the Major Prize winner’s and their companion’s names, likeness, images and/or voices (including photograph, film or recording of the same) from (but not limited to) their participation in the Major Prize, in any media for an unlimited period without further notification, compensation or remuneration for the purpose of promoting, publicizing or marketing this promotion (including the Major Prize and any outcome) and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and/or its partnering clients. The winner and their companion agree that they will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its partnering agents;

that they may be required to agree to a code of conduct and/or sign a legal release or releases in the form determined by the Promoter in its sole discretion prior to participating in the Major Prize. Failure to do so as determined by the Promoter (in the Promoter’s absolute and sole discretion) will result in the Major Prize winner forfeiting their prize;

that they may be required to participate in the Major Prize in accordance with any rules of engagement determined by the Promoter in its sole discretion and provided to the winner and their companion (if any) prior to travel (Rules); and

that should they breach these Terms of Entry whilst taking the Major Prize the Promoter may, in its discretion, immediately invalidate the relevant Major Prize winner’s entry, withdraw all further rights to the Major Prize and direct the Major Prize winner and their companion to immediately return to Australia at their own expense. This action will be determined by the Promoter in its sole discretion and no correspondence will be entered into.

8.2 All flights will be provided by Qantas or an affiliated airline.

8.3 All components of the Major Prize must be taken together and when offered or are forfeited. Any element of the Major Prize not taken will be deemed to be forfeited. The Major Prize winner and their companion must travel together and participate in the Major Prize together at all times.

8.4 Participation in the Major Prize and any tickets, passes or vouchers issued as part of the Major Prize may be subject to prevailing Major Prize supplier terms and conditions of use.

8.5 All components of the Major Prize are to be arranged by a representative of the Promoter and/or an agent nominated by the Promoter in its sole discretion.

8.6 If the Major Prize winner and their companion miss the flight from Sydney, Australia to New York City, New York, USA, the Major Prize winner will forfeit the Major Prize (at the Promoter’s absolute and sole discretion).

8.7 The Major Prize winner and their companion must hold a current and valid passport with at least 6 months validity from the Travel Date. The Major Prize winner and their companion must provide a copy of their passports at the time of winning to verify the validity. If the Major Prize winner and/or their companion do not supply their passports as requested, the Major Prize winner will forfeit the Major Prize as determined by the Promoter in the Promoter’s absolute and sole discretion.

8.8 The Major Prize winner and their companion must prepare all necessary paperwork and apply for any relevant visas (including an Electronic System for Travel Authorisation (ESTA)) to enable them to travel to, and remain in, the USA and participate in the Major Prize (at their own cost). Major Prize winners should consult the Embassy or Consulate of The United Stated of America or https://esta.cbp.dhs.gov/esta/ for up-to-date information to ensure they can obtain the required visa prior to travel, in order to accept the Major Prize. If the Major Prize winner and/or their companion is unable to obtain an ESTA or any other relevant visa or travel document, and/or is refused entry into the USA, the Major Prize winner will forfeit the Major Prize.

8.9 The Major Prize winner and/or their companion must have a valid credit card.

8.10 The Major Prize winner is required to travel with their Mobile Phone Handset at all times to ensure they are accessible throughout the tour.

8.11 Any amendment fees issued by an airline or other Major Prize supplier as a result of an action of the Major Prize winner and/or their companion (for example, missing a flight or transfer) will be the responsibility of the Major Prize winner.

8.12 Additional spending money, meals (other than those included or covered by the daily per diems) and any other ancillary costs, including, but not limited to, travel insurance and any applicable insurance excesses, not listed in the Major Prize details above are the responsibility of the Major Prize winner and their companion as incurred.

8.13 The Promoter takes no responsibility for loss or injury suffered by the Major Prize winner and/or their companion as a result of taking the Major Prize.

8.14 The Major Prize winners and their companion are responsible for obtaining their own valid travel insurance for their period of travel and adequate for the countries of travel.

8.15 No portion of the Major Prize is redeemable for cash. The Major Prize is not refundable or transferable.

8.16Taking the Major Prize is subject to the Rules (if any) and any prevailing terms and conditions of any accommodation/transport/experience/ services/transfers/travel insurance or tour providers, and in particular, health, behaviour, age and safety requirements. The Major Prize winner and their companion must follow the Rules (if any) and all reasonable directions given by the Promoter and any Major Prize supplier during the course of their participation in the Major Prize, including all directions in relation to health, age, behaviour, safety and legal and responsible consumption of alcohol. No compensation will be payable if the winner and/or their companion are unable to use any element of the Major Prize as stated for whatever reason, including refusal of entry or departure into or out of USA or participation in any other activities for health, age, behaviour or safety reasons. If the Major Prize winner or their companion fails to participate in the Major Prize in the manner required, as stated in this condition and/or in the reasonable opinion of the Promoter or any Major Prize supplier, the balance of the Major Prize will be forfeited with no compensation payable.

8.17 The Major Prize winner and their companion must adhere to any and all local government laws and regulations, including around the consumption of alcohol and gambling. The Promoter takes no responsibility for any actions taken by local authorities if the Major Prize winner and/or their companion break any local laws. The Major Prize winner and their companion should make themselves aware of the local laws and penalties of the USA. Serious and severe penalties exist for underage drinking and drug offences. The death penalty can be enforced in some states of the USA for criminal acts such as murder, rape and crimes against the state including treason and threats to Homeland Security including acts of terrorism.

8.18 The Australian Department of Foreign Affairs and Trade issues travel warnings and updates for travellers. The Promoter recommends that the Major Prize winner and their companion consult www.smarttraveller.com.au for advice and information prior to undertaking travel.

8.19 Transfers outlined in the Major Prize details above are at the absolute and sole discretion of the Promoter. Any additional transfers, including taxis, will need to be covered by the Major Prize winner and their companion.

8.20 The Major Prize winner and their companion must be in good health and must not have any pre-existing medical conditions that would prohibit them from flying to, entering and remaining in the USA, or participating in any way in the Major Prize. The Major Prize winner and their companion must declare to the Promoter and/or any Major Prize supplier any health-related issues that may affect their safe participation in any part of the Major Prize and obtain a written clearance from their doctor in this respect.

8.21 The Major Prize winner and their companion must not be under the influence of any drugs and may consume alcohol in moderation but must not be under the influence of alcohol during any activities to the extent that it impairs or affects their understanding, judgment or participation in the activities, and subject to any limitations of the Promoter, any Major Prize supplier and the prevailing laws and regulations of USA.

8.22 The Major Prize winner and their companion must not have a criminal record, outstanding warrants or any infringement notices that would prevent them from entering the USA.

8.23 The Promoter and/or any Major Prize supplier in their absolute discretion: (a) reserve the right to refuse to allow the Major Prize winner or their companion to take part in any or all aspects of the Major Prize if they reasonably believe the Major Prize winner or their companion poses a safety risk or for any other reason; and (b) may cancel the relevant component of the Major Prize if the conditions are deemed dangerous. No compensation will be payable if the Major Prize winner or their companion are unable to use any element of the Major Prize as stated for whatever reason, including refusal of participation in certain activities for health, age, behaviour or safety reasons.

8.24 The Promoter reserves the right to disqualify the Major Prize winner or their companion, prohibit the Major Prize winner’s or their companion’s participation in the Major Prize or any component of the Major Prize, or otherwise cease to provide any Major Prize benefit to the winner or their companion, if the Major Prize winner or their companion act in a way, or cause material to be published, which the Promoter in its sole discretion deems to be inappropriate, aggressive, defamatory, offensive, or contrary to law or the Rules (if any), to diminish the good name or reputation of any Major Prize supplier and/or the Promoter, its products and/or services or any of its related bodies corporate, or is otherwise not in keeping with the spirit of the promotion. For the avoidance of doubt, the Major Prize winner can be disqualified after the Major Prize winner is notified and published if the Major Prize winner or their companion is found to have not acted in accordance with these Terms of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
