The # FlySomewhereNew competition, brought to you by Cathay Pacific Airways Limited 國泰航空有限公司 (“Cathay Pacific” for short) will be governed by these rules (the “Official Rules” for short). The promotion is in no way sponsored, administered or endorsed by Facebook, Instagram or Twitter. All information provided is provided to Cathay Pacific.
1. ELIGIBILITY

Eligible participants must be at least 18 years of age and be a resident of Australia (“Participants” for short).

Employees and directors of Promoter and its licensees, advertising, promotion or production agencies and provider companies (and their respective dependents, immediate family members and individuals residing in their same household) are not eligible to participate.

The Promoter and its associated companies reserve the right, at any time, to verify the eligibility of Participants.
2. COMPETITION PERIOD

The competition begins on Tuesday August 12, 2014 and will run until 23:59 (AEST) on Thursday September 4, 2014 (the “Competition Period” for short).
3. HOW TO PARTICIPATE

Participants will have the opportunity to enter the #FlySomewhereNew promotion through Instagram, Twitter or a Facebook application housed on Cathay Pacific Australia’s Facebook page. Participants may only enter the competition one (1) time from each of these accounts.

To enter the #FlySomewhereNew Competition, users must first upload an image, related to a previous holiday, either:

Via a public Instagram account by following @CathayPacific and posting an entry, tagging the account and including the hashtag #FlySomewhereNew.

Via a public Twitter account by following @CathayPacificAU and Tweeting an entry, tagging the account and including the hashtag #FlySomewhereNew.

Through the Facebook application housed on Cathay Pacific Australia’s page.

Once received, Cathay Pacific will return information about a suggested “new” destination, either directly through the Facebook app, or via Instagram or Twitter comments or replies respectively. In each of these cases, the client must accept their destination assignment and agree to competition terms and conditions to be entered into the contest.

To access the Campaign, Participants must have access to the World Wide Web (internet) provided by an Internet Service Provider (“ISP”) of their choosing & a Facebook enabled mobile handset serviced by a Telecommunications Provider and must pay any applicable ISP, operator, service and other fees necessary for such access.
4. THE INFORMATION SUBMITTED BY YOU

Promoter respects the privacy of its customers and the information submitted by the Participant to the Promoter will only be used by Promoter, in accordance with the Participant’s instructions upon entry and with applicable data protection regulations and the Promoter’s online privacy policy (the “Privacy Policy“) available on their website. However, any information submitted within Facebook will be governed by the privacy policy of Facebook. Please consult the Privacy Policy and/or Facebook privacy policy for more details on how Promoter/Facebook handles information submitted by you (“Personal Information” for short).
5. PRIZES

One (1) winner, chosen by a panel of internal Cathay Pacific officials, will be awarded with 2 return economy class tickets (including taxes and surcharges) from one chosen departure city in Australia i.e. Adelaide, Brisbane, Cairns, Melbourne, Perth or Sydney to one destination chosen during campaign entry served by Cathay Pacific (the “Major Prize” for short).

Prizes are for off-peak travel during 2015 (14th January 2015 – 13th December 2015) and are awarded up to a retail value of $5,000. Prizes are non-refundable, nontransferable and non-negotiable. No frequent flyer points may be accrued for the prizewinner tickets.

The winner shall submit his/her booking requests and travelling companion details through direct communications with Cathay Pacific’s marketing team. All bookings are subject to availability and the organizer retains final discretion as to whether to accept the Winner’s flight booking request. The prize will be forfeited if no bookings are made by February 30th, 2015, and the winner will not be entitled to any payment or compensation from the Organizer if the prize is forfeited or not used in full.

The prize is for air travel only to destination assigned during the competition period only. Any additional or incidental expenses, including accommodation, transport costs, cost arising due to injury or illness or any other expenses incurred through the trip, shall be the sole responsibility of the winner.
6. DETERMINATION OF THE WINNER

One (1) Major Prize winner will be selected by Cathay Pacific Australia Marketing team on Wednesday September 10, 2014 from the pool of eligible entrants. The winning entry will be that that Cathay Pacific deem to be the most in need of their assigned holiday alternative, judged at the sole discretion of the Promoter. The decision is final and no correspondence will be entered into.

The winner will be notified via comment or response to their entry by 13:00 on Thursday September 11, 2014.

After receiving a winning notification, Participants must confirm their contact details via email within 72 hours of being contacted by Promoter to arrange delivery of their prize. Cathay Pacific will not post their image or announce the winner’s identity until their acceptance has been confirmed.

If the winner fails to contact the Promoter within the 72 hours after notification, the winner shall forfeit the Prize. In this event, Promoter shall select another winner from the remaining eligible entries or dispose of the Prize in any way it deems fit.

Prizes will be dispatched on or before Friday November 28, 2014.
7. GENERAL RULES

By taking part in this competition, Participants consent to comply with these Official Rules and the Privacy Policy.

Other than for death or personal injury arising from negligence of the Promoter or for anything else that cannot be excluded by law, so far as is permitted by law the Promoter excludes all liability for any disappointment, loss, damage, injury, cost and expense, whether direct or indirect, howsoever caused in connection with the Promotion or any aspect of the Prize.

If a winner is found to be ineligible or not in compliance with these Official Rules the winner’s Prize will be forfeited and an alternate winner selected.

No purchase is necessary.
8. RIGHT TO USE ANY SUBMITTED CONTENT

By submitting, and upon such submission of, any information or materials such as (but not limited to) data, text, photographs, likeness, messages and Facebook information or the like, or any other material (the “Content” for short) to Promoter or through the Site, you license and grant to Promoter a non-exclusive, royalty-free and free of charge, perpetual, worldwide, irrevocable, and fully sub-licensable right to use, reproduce, copy, modify, adapt, communicate to the public, make available, publish, translate, create derivative works of, distribute, and display such Content or any concept described in it throughout the world in any media, product and/service so that the Promoter may make the fullest use of the Content, without compensation, or any restrictions on use, accountability or liability, and with waiver of all moral rights to the extent permitted by applicable laws. With regard to such Content submissions, you understand and agree that you are solely and fully responsible for any and all aspects of the Content submitted, including but not limited to its legality, appropriateness and non-infringement of third party intellectual property rights, and the Promoter shall not be liable in any way for such Content. You also acknowledge and understand that any submitted Content may be visible to anyone, anywhere.

The promoter will have full moderation over entries submitted to ensure suitability & appropriateness for the contest. Inappropriate content includes, but is not limited to, content that is offensive, discriminative, lewd, and violent or any other content deemed inappropriate to display by Cathay Pacific.

Though all entries adhere to the usage rights listed above, only entries submitted through Facebook will be listed on the gallery page of the Facebook application. Content submitted through Instagram or Twitter will not be posted here, however Cathay Pacific retain the right to post or otherwise use this content for marketing purposes as they see fit.

Promoter may expect the winner of the Promotion to take part in reasonable public relations activities and promotional events promoting Promoter products. Any appearance made by the winner will be subject to a separate agreement made between Promoter and the winner.
9. INTERNET

Neither Promoter nor its associated companies can accept any responsibility for lost, late, damaged, misdirected, unintelligible, or interrupted entries, which shall be deemed invalid. Proof of submission of entry will not constitute proof of receipt of entry.

To the fullest extent permitted by applicable law, Promoter is not responsible for loss or damage to Participants’ or to any other person’s computer related to or resulting from participating in the Promotion or downloading materials from or use of the Site. Should any portion of the Promotion be, in Promoter’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of Promoter, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Promoter reserves the right at its sole discretion to suspend, modify or terminate the Promotion, and select the winner at random from all entries received prior to action taken or as otherwise deemed fair and appropriate by Promoter.

11. MISCELLANEOUS

These Official Rules are governed by the laws of Australia.

To the maximum extent permitted by applicable law, Promoter reserves the right at its sole discretion to amend, withdraw or revise these Official Rules and the Prizes at any time without notice and in such event Promoter shall not have any liability whatsoever.

You acknowledge and agree that no form of cheating will be tolerated. Any persons found cheating, as determined in the sole and absolute discretion of Promoter, will immediately be disqualified from the Promotion. Cheating includes, but is not limited to, tampering, hacking of website, entering the Promotion without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Promotion, exploiting any software bugs, use of the Promotion beyond the defined rules of the Promotion, attempting to disable or overwhelm any of the Promoter sites, attempts to disrupt any portion of the Promotion, including, but not limited to, allowing somebody else use your Personal Information, tampering with entry process or operation of promotion or Site.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF THE PROMOTER SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

You acknowledge and agree that all disputes in relation to the Promotion shall be determined in the sole and absolute discretion of Promoter, and that such a decision shall be final and binding.
